1. القبول
تنظم شروط الاستخدام هذه («الشروط») علاقتك بتطبيق Capital Vibes («التطبيق») الذي تطوّره وتشغّله Addady [[TBD: الاسم القانوني للكيان]] («نحن»). بتثبيت التطبيق أو استخدامه فإنك تقرّ بأنك قرأت هذه الشروط وسياسة الخصوصية ووافقت عليهما. إذا لم توافق، فلا تستخدم التطبيق.
يجب أن تكون قد بلغت 13 عاماً على الأقل لاستخدام التطبيق، أو أن تستخدمه بإشراف ولي أمرك.
2. الخدمة وطبيعتها التجريبية
يقدّم التطبيق دليلاً لوسائل النقل في العاصمة الإدارية الجديدة: خطوط القطار الكهربائي الخفيف والمونوريل وحافلات العاصمة والخطوط بين المدن، ومواعيدها وأسعارها ومحطاتها، ومخطط رحلات، وحاسبة تكلفة، وتنبيهات اختيارية، وزر «ركبت هذا» لتأكيد المواعيد من واقع الركوب الفعلي.
الإصدار الحالي نسخة تجريبية (Beta). قد تتغير المزايا أو تُزال، وقد تظهر أخطاء، وقد تحمل بعض الخطوط شارة «قيد التحقق» حتى يتم التأكد منها على الأرض. التطبيق مجاني ولا يحتوي على إعلانات.
3. دقة البيانات وإخلاء المسؤولية
Capital Vibes منتج خاص ومستقل. وهو ليس تابعاً لشركة العاصمة الإدارية للتنمية العمرانية (ACUD) أو الهيئة القومية للأنفاق (NAT) أو RATP Dev Mobility Cairo أو هيئة النقل بالعاصمة الإدارية (ACTA) أو هيئة النقل العام بالقاهرة (CTA) أو أي مشغّل أو جهة حكومية، ولا يمثّل أياً منهم ولا يتحدث باسمهم.
تُجمع المواعيد والأسعار والمحطات من مصادر عامة (إعلانات المشغّلين، ولوحات المحطات، والأخبار المنشورة) ومن تأكيدات الركاب. ورغم حرصنا على التحقق منها بالركوب الفعلي، فقد تكون غير دقيقة أو غير محدّثة أو مختلفة عن الواقع في يوم معيّن بسبب الأعطال أو تغييرات التشغيل أو العطلات.
تُقدَّم المعلومات «كما هي» وللاسترشاد فقط. تحقّق دائماً من المواعيد والأسعار لدى المشغّل قبل أي رحلة مهمة. لا نتحمل أي مسؤولية عن رحلة فاتتك، أو وقت ضاع، أو فرق في سعر تذكرة، أو أي خسارة ناتجة عن الاعتماد على المعلومات المعروضة في التطبيق.
4. الاستخدام المقبول
عند استخدام التطبيق، توافق على ألا تقوم بما يلي:
إرسال تأكيدات «ركبت هذا» أو بلاغات غير صحيحة أو مضلّلة، أو تكرار الإرسال آلياً
استخراج بيانات التطبيق أو واجهته البرمجية بشكل آلي أو جماعي (scraping) أو إعادة نشرها بوصفها خدمة منافسة دون إذن كتابي
تعطيل الخدمة أو تجاوز ضوابطها الأمنية أو التحميل عليها بشكل غير معتاد
إدراج محتوى غير قانوني أو مسيء أو بيانات شخصية لأطراف أخرى في البلاغات أو الملاحظات
انتحال صفة مشغّل أو جهة رسمية أو شخص آخر
الهندسة العكسية للتطبيق إلا في الحدود التي يجيزها القانون أو رخص المصادر المفتوحة المرفقة
يحق لنا تجاهل أي تأكيد أو بلاغ نشتبه في صحته، وحظر المعرّفات المسيئة دون إخطار.
5. مشاركاتك: التأكيدات والبلاغات والملاحظات
تحتفظ بملكية ما ترسله. وبإرسال تأكيد أو بلاغ أو ملاحظة، تمنحنا ترخيصاً عالمياً وغير حصري ومجانياً ودائماً وقابلاً للترخيص من الباطن لاستخدام تلك المشاركة ونسخها وتعديلها وتجميعها ونشرها — بما في ذلك دمجها في بيانات المواصلات وعرض الأعداد المجمّعة للركاب — دون أي مقابل ودون نسبها إليك.
تقرّ بأن ما ترسله صحيح وفق علمك، وأنه لا ينتهك حقوق الغير، وأنك لا ترسل بيانات شخصية لأشخاص آخرين. يمكنك طلب حذف مشاركاتك الفردية وفق سياسة الخصوصية؛ ولا يشمل ذلك الأعداد المجمّعة التي لم تعد تعرّفك.
6. الملكية الفكرية وإسناد المصادر
التطبيق وتصميمه وشعاره واسمه وشفرته ونصوصه وطريقة عرض البيانات مملوكة لـ Addady أو مرخّصة لها، ومحمية بقوانين الملكية الفكرية. نمنحك رخصة شخصية غير حصرية وغير قابلة للتحويل لاستخدام التطبيق لأغراضك غير التجارية وفق هذه الشروط.
البيانات المعروضة مجمّعة من مصادر عامة، ونذكرها بالإسناد: RATP Dev Mobility Cairo (تشغيل القطار الكهربائي الخفيف)، والهيئة القومية للأنفاق (المونوريل والقطار فائق السرعة)، وهيئة النقل بالعاصمة الإدارية (حافلات C)، وهيئة النقل العام بالقاهرة (خط التجمع الخامس)، والمشغّلون الخاصون لمكوكات القاهرة الكبرى (أجياد، ستار لاين، الإبراهيمية، البريق)، والإعلانات الرسمية والصحافة المنشورة. تُدرج قائمة المصادر التفصيلية في وثائق التطبيق، ويبقى كل اسم تجاري وشعار ملكاً لأصحابه.
يُبنى التطبيق على مكوّنات مفتوحة المصدر؛ وتُرفق قائمة رخصها مع كل إصدار.
7. خدمات الطرف الثالث
قد يفتح التطبيق، بطلب منك، خدمات خارجية مثل واتساب وخرائط Google وتطبيق Capital Taxi ومواقع المشغّلين وورقة المشاركة في نظام التشغيل. تخضع هذه الخدمات لشروطها وسياساتها الخاصة، ولا نتحمل مسؤولية محتواها أو توافرها أو ما تجمعه من بيانات.
8. توافر الخدمة والتغييرات
نسعى لإبقاء التطبيق متاحاً باستمرار، ويعمل معظمه بلا إنترنت. لكننا لا نضمن توافر الخوادم أو التنبيهات أو المزامنة في كل وقت، وقد نوقف الخدمة أو نعدّلها أو نضيف مزايا أو نزيلها، مؤقتاً أو نهائياً، دون إخطار مسبق. وقد تتطلب بعض المزايا تحديث التطبيق إلى أحدث إصدار.
9. حدود المسؤولية
إلى الحد الأقصى الذي يجيزه القانون المصري، يُقدَّم التطبيق «كما هو» و«حسب توافره» دون أي ضمانات صريحة أو ضمنية، بما في ذلك ضمانات الدقة أو الملاءمة لغرض معيّن أو عدم الانقطاع.
لا نتحمل، نحن أو مؤسسونا أو العاملون لدينا أو شركاؤنا، أي مسؤولية عن الأضرار غير المباشرة أو التبعية أو العرضية أو الخاصة، أو عن فوات الكسب أو ضياع الوقت أو فوات رحلة أو موعد، الناشئة عن استخدام التطبيق أو تعذّر استخدامه. ولا يسري هذا الحد على المسؤولية التي لا يجيز القانون استبعادها، ولا على الأضرار الناتجة عن غش أو خطأ جسيم من جانبنا.
10. التعويض
توافق على تعويضنا ودفع الضرر عنا تجاه أي مطالبة أو خسارة أو مصروفات (بما فيها أتعاب المحاماة المعقولة) تنشأ عن إخلالك بهذه الشروط، أو عن مشاركاتك، أو عن استخدامك للتطبيق بالمخالفة للقانون.
11. الإنهاء
يمكنك إنهاء هذه الاتفاقية في أي وقت بحذف التطبيق من جهازك. ويحق لنا تعليق أو إنهاء وصولك إلى الخدمات المتصلة (المزامنة والتنبيهات) إذا أخللت بهذه الشروط. تبقى الأقسام المتعلقة بالملكية الفكرية والمشاركات وحدود المسؤولية والتعويض والقانون الواجب التطبيق سارية بعد الإنهاء.
12. القانون الواجب التطبيق والاختصاص القضائي
تخضع هذه الشروط وتُفسَّر وفقاً لقوانين جمهورية مصر العربية. وتختص محاكم القاهرة دون غيرها بالفصل في أي نزاع ينشأ عنها، مع عدم الإخلال بأي حقوق لا يجيز القانون التنازل عنها للمستهلكين في بلد إقامتهم.

13. التعديلات
قد نعدّل هذه الشروط من وقت لآخر. يظهر رقم الإصدار وتاريخ السريان في أعلى الصفحة وداخل التطبيق. وعند إجراء تعديل جوهري سنخطرك داخل التطبيق قبل سريانه، وسننشر النسخة الجديدة على capitalvibes.addady.app/terms. استمرارك في استخدام التطبيق بعد تاريخ السريان يعني قبولك للشروط المعدّلة.
14. اللغة
حُررت هذه الشروط باللغة العربية، والنسخة الإنجليزية ترجمة لتيسير الفهم. في حال وجود أي تعارض أو اختلاف في التفسير، يُعتد بالنص العربي.
15. أحكام عامة
إذا قُضي ببطلان أي بند من هذه الشروط، يبقى باقي البنود نافذاً. ولا يُعد عدم ممارستنا لأي حق تنازلاً عنه. لا يجوز لك التنازل عن حقوقك بموجب هذه الشروط دون موافقتنا الكتابية، ويجوز لنا التنازل عنها لأي خلف في ملكية التطبيق. تشكّل هذه الشروط وسياسة الخصوصية كامل الاتفاق بيننا بشأن التطبيق.

1. Acceptance
These Terms of Use (the "Terms") govern your relationship with the Capital Vibes app (the "App"), developed and operated by Addady [[TBD: legal entity name]] ("we", "us"). By installing or using the App you confirm that you have read and accepted these Terms and the Privacy Policy. If you do not agree, do not use the App.
You must be at least 13 years old to use the App, or use it under the supervision of a parent or guardian.
2. The service and its beta nature
The App is a guide to public transport in the New Administrative Capital: the LRT, monorail, Capital bus and intercity lines with their timetables, fares and stations, a trip planner, a fare calculator, optional alerts, and an "I rode this" button that lets riders confirm timetables from actual rides.
The current release is a beta. Features may change or be removed, errors may appear, and some lines may carry a "pending verification" badge until they have been checked on the ground. The App is free and contains no advertising.
3. Accuracy of data and disclaimer
Capital Vibes is a private, independent product. It is not affiliated with the Administrative Capital for Urban Development (ACUD), the National Authority for Tunnels (NAT), RATP Dev Mobility Cairo, the Administrative Capital Transport Authority (ACTA), the Cairo Transport Authority (CTA) or any operator or government entity, and it does not represent or speak for any of them.
Timetables, fares and stops are compiled from public sources (operator announcements, station boards and published news) and from rider confirmations. Although we take care to verify them by riding, they may be inaccurate, out of date or different from reality on a given day because of disruptions, operational changes or holidays.
The information is provided "as is" and for guidance only. Always check times and fares with the operator before any important trip. We accept no liability for a missed trip, lost time, a fare difference or any loss resulting from reliance on the information shown in the App.
4. Acceptable use
When using the App you agree not to:
Submit false or misleading "I rode this" confirmations or reports, or submit them automatically or repeatedly
Scrape or bulk-extract the App's data or API, or republish it as a competing service without written permission
Disrupt the service, bypass its security controls or load it in an unusual way
Include unlawful or abusive content, or other people's personal data, in reports or feedback
Impersonate an operator, an official body or another person
Reverse-engineer the App beyond what the law or the bundled open-source licences allow
We may disregard any confirmation or report whose accuracy we doubt and block abusive identifiers without notice.
5. Your submissions: confirmations, reports and feedback
You keep ownership of what you submit. By sending a confirmation, report or feedback you grant us a worldwide, non-exclusive, royalty-free, perpetual and sublicensable licence to use, copy, adapt, aggregate and publish that submission — including merging it into the transit data and showing aggregate rider counts — without payment and without attribution to you.
You confirm that what you submit is accurate to your knowledge, does not infringe anyone's rights, and does not include other people's personal data. You may ask us to delete your individual submissions as described in the Privacy Policy; this does not extend to aggregate counts that no longer identify you.
6. Intellectual property and data source attribution
The App, its design, logo, name, code, texts and the way it presents data are owned by or licensed to Addady and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable licence to use the App for your own non-commercial purposes under these Terms.
The data shown is compiled from public sources, which we credit: RATP Dev Mobility Cairo (LRT operations), the National Authority for Tunnels (monorail and high-speed rail), the Administrative Capital Transport Authority (C buses), the Cairo Transport Authority (the 5th Settlement line), the private operators of the Greater Cairo shuttles (Ajyad, Star Line, El-Ibrahimia, El-Bareeq), and official announcements and published press. The detailed source list is kept in the App's documentation, and every trade name and logo remains the property of its owner.
The App is built on open-source components; the list of their licences ships with every release.
7. Third-party services
At your request the App may open external services such as WhatsApp, Google Maps, the Capital Taxi app, operator websites and the operating-system share sheet. These services are governed by their own terms and policies, and we are not responsible for their content, availability or the data they collect.
8. Availability and changes
We aim to keep the App available at all times, and most of it works offline. We do not, however, guarantee that the servers, alerts or sync will be available at every moment, and we may suspend, modify, add or remove features, temporarily or permanently, without prior notice. Some features may require updating the App to the latest version.
9. Limitation of liability
To the fullest extent permitted by Egyptian law, the App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose or uninterrupted operation.
Neither we nor our founders, staff or partners are liable for indirect, consequential, incidental or special damages, or for lost profits, lost time, or a missed trip or appointment, arising from the use of or inability to use the App. This limitation does not apply to liability that cannot be excluded by law, or to damage caused by our fraud or gross negligence.
10. Indemnity
You agree to indemnify and hold us harmless against any claim, loss or expense (including reasonable legal fees) arising from your breach of these Terms, from your submissions, or from your use of the App in violation of the law.
11. Termination
You may end this agreement at any time by deleting the App from your device. We may suspend or terminate your access to the connected services (sync and alerts) if you breach these Terms. The sections on intellectual property, submissions, limitation of liability, indemnity and governing law survive termination.
12. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of the Arab Republic of Egypt. The courts of Cairo have exclusive jurisdiction over any dispute arising from them, without prejudice to any consumer rights that cannot be waived under the law of your country of residence.
We encourage you to contact us first so we can resolve any disagreement amicably.
13. Changes
We may amend these Terms from time to time. The version number and effective date appear at the top of this page and inside the App. For a material amendment we will notify you inside the App before it takes effect and publish the new version at capitalvibes.addady.app/terms. Continuing to use the App after the effective date means you accept the amended Terms.
14. Language
These Terms were drafted in Arabic; the English version is a translation provided for convenience. In the event of any conflict or difference in interpretation, the Arabic text prevails.
15. General provisions
If any provision of these Terms is held invalid, the remaining provisions stay in force. Our failure to exercise a right is not a waiver of it. You may not assign your rights under these Terms without our written consent; we may assign them to any successor in ownership of the App. These Terms and the Privacy Policy form the entire agreement between us regarding the App.
